Terms of Use
1. Provider and scope
These terms govern your use of the Writai: AI Writing Assistant app (“Writai”, “the app”), provided by Nazli Mahmudlu, Spreestraße 5, 12439 Berlin, Germany (“we”, “us”), email: mahmudlunaz@gmail.com. By using the app you agree to these terms. Our Privacy Policy explains how we handle your data.
2. The service
Writai uses artificial intelligence to improve texts and suggest replies. You can use it in the app’s editor or, if you turn on the optional Accessibility service, through a floating button in other apps. An internet connection is required.
3. AI-generated content
- Results are generated automatically by an AI model and may be inaccurate, incomplete, inappropriate or not suitable for your purpose. Always review results before you use or send them. You are responsible for the texts you send.
- Writai does not provide legal, medical, financial or other professional advice.
- Similar inputs may produce similar results for other users, so we cannot guarantee that a result is unique.
- If you receive offensive or harmful output, please report it to mahmudlunaz@gmail.com so we can improve our safeguards.
4. Your content
You keep all rights to the texts you submit and, as far as legally possible, to the results generated for you. You give us the right to process your texts solely to provide the service, as described in the Privacy Policy. We do not use your texts to train AI models. You must have the right to use any text you submit and must not submit content that violates the rights of others.
5. Acceptable use
You must not use Writai to:
- create or distribute illegal content, or content that harasses, threatens, defames or discriminates against others;
- create spam, fraud or phishing messages, or impersonate other people;
- circumvent usage limits, technical protections or the app’s integrity checks, or access our server other than through the app;
- reverse engineer, resell or commercially exploit the service without our permission.
We may restrict or suspend access if these terms are seriously breached.
6. Free plan and Writai Pro
The free plan includes a limited number of improves and smart replies per day. The current limits are shown in the app. Writai Pro is a paid subscription that removes the daily limits, subject to a fair-use limit that protects the service from abuse, and gives access to our most capable AI model.
6.1 Purchase and billing
- Subscriptions are purchased and billed through Google Play using your Google account. Google Play’s terms of service also apply.
- The price, billing period and any free trial are shown in the app and on the Google Play payment screen before you buy.
- Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends.
- If a free trial is offered and you do not cancel before it ends, the subscription starts and is charged automatically.
- You can manage or cancel your subscription at any time in Google Play → Payments & subscriptions → Subscriptions. After cancellation, Pro stays active until the end of the period you have paid for.
- Refund requests are handled according to Google Play’s refund policies. Your statutory rights are not affected.
6.2 Right of withdrawal for consumers in the EU
If you are a consumer in the EU, you have a statutory right to withdraw from the subscription contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded. To exercise it, inform us of your decision (e.g. by email to mahmudlunaz@gmail.com) or request a refund via Google Play before the period ends.
If you withdraw, we refund all payments received from you without undue delay and no later than 14 days after we receive your withdrawal notice, using the same means of payment. If you asked for the service to begin during the withdrawal period, you have to pay an amount proportionate to the service already provided up to the time you inform us of the withdrawal.
7. Accessibility service
The Accessibility service is optional. It is used only to provide the writing features in other apps, as described in the app and in our Privacy Policy. You can turn it off at any time in your device settings.
8. Availability and changes
We work to keep Writai available but cannot guarantee uninterrupted service, for example during maintenance or outages of our AI provider. We may further develop the app and change features where this is reasonable for you. We will not remove essential features of an active paid subscription without a valid reason.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are liable only for breach of an essential contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible and on which you may regularly rely), and limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded. Statutory consumer rights remain unaffected.
10. Ending use
You can stop using Writai at any time by uninstalling the app. Paid subscriptions must be cancelled separately in Google Play.
11. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you usually live.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
12. Changes to these terms
We may update these terms, for example when features or legal requirements change. We will inform you of material changes in the app in good time. The current version is always available at writai.app/terms.
